Caitlin P. Strauss

Caitlin Piccarello Strauss concentrates her practice on complex commercial and employment litigation matters and has extensive experience litigating in Pennsylvania state and federal courts.  Caitlin has worked with clients in the food and beverage, financial services, insurance, retail, and telecommunications industries, among others.  Caitlin has particular experience representing companies in restrictive covenant and trademark infringement matters.

Experience

Complex Commercial Litigation

  • Represented telecommunications company defending action by landowner alleging trespass and successfully obtaining complete dismissal of action
  • Represented commercial jetliner manufacturer in dispute brought by former employee of independent contractor and secured complete defense verdict after binding arbitration
  • Represent bankruptcy court-appointed independent examiner investigating creditors’ allegations of wrongdoing in the $3.6 billion leveraged buyout of the Tribune Company
  • Represented employer and employees in catastrophic workplace accident at manufacturing facility and resulting wrongful death and products liability actions
  • Participated in  bench trial in Pennsylvania state court involving a breach of contract claim, winning verdict in client's favor
  • Participated in private arbitration on behalf of debt settlement services company in breach of contract dispute

Restrictive Covenants and Trade Secrets

  • Defend brokerage firm and employees against claims of employee raiding, unfair competition, breach of fiduciary duty, misappropriation of trade secrets and civil conspiracy in Pennsylvania state court action
  • Represent employer in suit against executive officer for breach of forfeiture for competition provision in severance agreement
  • Defend brokerage firm against claims by competitor firm for employee raiding, unfair competition, misappropriation of trade secrets, breach of fiduciary duty and civil conspiracy in Financial Industry Regulatory Authority (FINRA) arbitration
  • Participated in a three-week FINRA arbitration involving claims against a brokerage firm and four individual brokers for employee raiding and breach of fiduciary duty
  • Represent brokers throughout the country, advising them on their obligations under the Protocol for Broker Recruiting and defending them against suits brought by former employers
  • Represent employer in employment contract dispute against former CEO, defeat summary judgment for employee and obtain summary judgment for employer as the non-moving party

Intellectual Property and Trademark Infringement Litigation

  • Represent footwear manufacturer in breach of contract action involving dispute over marketing and licensing agreement for sale of orthotic inserts
  • Represented background check company in trademark infringement suit
  • Represent vitamin and dietary supplement manufacturer in federal court action involving claims of trademark infringement, false advertising and violation of consumer protection laws

Food and Beverage Industry

  • Represented food processing facility in major premises liability action brought by contractor
  • Represented food manufacturer and retail store in products liability actions brought by consumers
  • Represent energy drink manufacturer in breach of contract action against distributor

Insurance

  • Represented transportation and logistics company in breach of contract dispute with worker’s compensation nurse management vendor and insurance company
  • Represent insurer in ERISA litigation matters involving group disability and life insurance benefit plans
  • Represent title insurer in multimillion dollar defalcation against title agent 
  • Represent commercial real estate services firm in premises liability dispute involving interpretation of indemnification provisions in insurance contract  

Securities Litigation

  • Defend employee and the chairman of the board of directors of a failed hedge fund in a multimillion dollar federal court action brought by investors
  • Represented defendant in defeating class certification in a Section 10(b) Securities Act class action brought by investors against the auditor of a subprime mortgage lender – a decision recently affirmed by the Third Circuit in an issue of first impression involving a novel application of the “fraud created the market” theory

Caitlin is a founding member and Chair of the firm’s Women's Development Initiative (WDI).  Her work for the WDI includes organizing a number of client and training events for the firm’s women attorneys.  Her experience wih the WDI have also led to her served on panels discussing issues implicated with women’s initiatives.  Caitlin was instrumental in organizing a meeting of the leaders of Philadelphia law firm women's initiatives, which provided a form for discussion and sharing ideas about each of the various firms' programs, and their missions, challenges and activities. She was asked by the Chancellor of the Philadelphia Bar Association to chair a newly-created Women in Law Firms Initiatives Task Force.

Caitlin also serves as a judge pro tempore for the Philadelphia Court of Common Pleas.
