Avoid A Hiring Hoopla: Learn to Limit Background Check Risks

Resume?  Check.  References?  Check.  Financial and criminal background screening … not so fast.  Although background checks are a common hiring tool, employers who use them incorrectly may face discrimination claims, Equal Employment Opportunity Commission enforcement actions and class-action lawsuits alleging violations of laws designed to protect employees from unfair hiring practices. 

Attorneys from the Labor, Employment and Employee Benefits Practice will lead this CLE* webinar about the risks associated with misusing background checks and how to avoid them.  They will also outline proper background check procedures, including meeting the requirements of the Fair Credit Reporting Act, and explain how much an employer may weigh an applicant’s criminal history in hiring. Other topics include:

  • Federal hiring laws and EEOC enforcement tactics
  • State and local hiring laws, including the Pennsylvania Criminal History Record Information Act and “Ban the Box” initiatives
  • Explanation of what constitutes negligent hiring practices
