Critical Handling of Customers and Suppliers in Financial Distress: A Bankruptcy Roadmap

An ounce of prevention is worth a pound of cure. In this CLE program, Teresa K.D. Currier and Lucian “Luke” Murley in the Bankruptcy and Restructuring Practice, will cover the ins and outs of doing business with an entity in financial distress. The seminar will teach you how to recognize early signs of danger and provide you with an arsenal of weapons to limit your exposure and increase your bottom line.

For example, a commercially savvy businessperson who recognizes a customer in distress can structure payments from that customer so that they cannot be clawed back as bankruptcy preferences. Similarly, advance payments to beleaguered suppliers can be managed to ensure that the funds are actually paid to sub-suppliers as promised, thus managing downside risk. Finally, asserting the right bankruptcy claim can elevate the amount owed from pennies-on-the-dollar to a debt that will be paid in full.

The CLE will take place in Saul Ewing’s Philadelphia Office, Centre Square West at 1500 Market Street. Breakfast and registration will be from 8:00 a.m. to 8:30 a.m. and the CLE will take place from 8:30 a.m. until 9:30 a.m.

This program has been approved by the Board on Continuing Legal Education of the Supreme Court of New Jersey for 1 hour of total CLE credit. Of these, 0 qualify as hours of credit for ethics/professionalism, and 1 qualify as hours of credit toward certification in civil trial law, criminal trial law, workers compensation law, municipal court law, and/or matrimonial law. This program has been approved by the Pennsylvania Continuing Legal Education Board for 1 hour of substantive law, practice and procedure CLE credit and 0 hours of ethics, professionalism or substance abuse CLE credit.
