DC Circ. Lets Pipeline Builder Intervene in Approval Fight

Law360 recently reported on a matter handled by Saul Ewing partners John Stoviak and Pamela Goodwin, in which their client, Transcontinental Gas Pipe Line Co. LLC (Transco) sought to intervene in a dispute between environmentalists and the Federal Energy Regulatory Committee (FERC) over the company’s proposed pipeline expansion in Pennsylvania and New Jersey.  The dispute centered around tree felling for the project, and Transco argued to the D.C. Circuit Court of Appeals that it was an indispensable party in the dispute as it would suffer substantial losses for each day the tree felling was stayed.  The Court granted Transco’s motion to intervene in the suit in order to protect its interests in the underlying litigation.
