Pennsylvania prohibits insurers from discriminating based on gender identity

Jeremy Heinnickel, an associate in Saul Ewing’s Insurance Practice, weighs in on new guidance from the Pennsylvania Insurance Commissioner that prohibits insurance companies from discriminating based on gender identity. In the article, Jeremy compares the notice, which was issued in May 2016, to a similar rule in Connecticut, explains the probable reasons behind the guidance and  notes the effects on insurance policies. 
 
“For example, the guidance does not expressly require an insurance company to offer coverage for a gender reassignment procedure. However, if a few months down the road, an insured person must be hospitalized due to complications resulting from the surgery, the guidance prevents the insurer from categorically denying coverage for these complications because they relate to gender transition,” Jeremy explains in the article.
