John Ropiequet publishes article on recent FTC advisory opinion

Arnstein & Lehr Chicago Partner John Ropiequet has published an article in the Banking & Financial Services Policy Report entitled “Will the FTC’s Advisory Opinion on the Holder in Due Course Rule Change the Treatment of Claims against Assignees?” The article discusses the FTC’s effort to reverse case precedent in numerous jurisdictions which has ruled that the Holder Notice language which the FTC’s regulations has required to be present in consumer credit sale contracts since 1975 has only limited application to contract assignees by issuance of an advisory opinion on the subject. The opinion by the full Commission argues that those cases have misinterpreted its regulations.
