Julian Montero Assists Same-Sex Couple in Receiving Immigration Benefits

Arnstein & Lehr Miami Partner Julian Montero successfully helped a UK native and his same-sex spouse receive immigration beneftis through an E-2 Investor Visa. This victory is one of the first instances since the repeal of the Defense of Marriage Act (DOMA) in which a same-sex spouse received a derivative immigration benefit throught a non-immigrant visa application. The E-2 Investor Visa allows an individual to enter and work in the United States based on an investment he or she will be controlling while inside the country. While spouses have consistently been able to attain derivative E-2 visas, same-sex couples were never afforded this opportunity prior to the repeal of DOMA.
