Saul Ewing team wins big victory for client, Tennessee Gas Pipeline Company, LLC
Court Says EHB May Not Review Certain DEP Permits

This article details Saul Ewing’s role in thwarting opposition attempts to stop construction of a $400 million pipeline program.

Partners Elizabeth Witmer and John Stoviak, along with associate Jennifer Beidel, represented Tennessee Gas after it was sued by Delaware Riverkeeper Network USA and other environmental groups on the state level. Tennessee Gas, a unit of Kinder Morgan Energy Partners LP, is building a 40-mile pipeline expansion to connect shale gas fields in northern Pennsylvania to several East Coast cities. The Delaware Riverkeeper Network and the Responsible Drilling Alliance tried to stop it through challenges in the U.S. District Court for the Middle District of Pennsylvania and the U.S. Court of Appeals D.C. Circuit.

In early February 2013, a federal District judge rejected the environmental groups’ attempt to get a Pennsylvania Environmental Hearing Board review of the pipeline permit. The judge ruled that only federal courts can review such cases. The next day, the D.C. Circuit rejected the environmental group’s request for a stay pending court review.
