John Englert, Co-Chair of the Firm’s Energy Generation Practice, is quoted in this Oil & Gas 360 article. John discusses the Clean Water Act (CWA), the CWA 401 certification and how some states are using it in regard to pipeline projects.

“When somebody applies for a Federal permit, in this case for a pipeline, they would be applying to FERC. If this project is going to impact waters of the United States, then they need to get a [CWA 401] certificate from the state saying that the project will comply with water quality standards in the state,” said John.

According to John, some states use the act to slow down pipeline projects by claiming the project may negatively impact state waters.
